| Аннотация |
This article analyzes criteria of justice and individualization of punishment and highlights that the ideas of humanization of criminal punishment are increasingly recognized and predetermines the need to reform the criminal law in the context of the consistent implementation of the proportionality requirement of a crime and the punishment, assuring their impartiality and convenience. The authors perform a comparative analysis of the criteria of impartiality and individualization, and indicate their non-coincidence. In his opinion, the individualization of punishment determines and implements only one aspect of the justice of punishment, determining that the criminal legislation of the Russian Federation has a certain bias in the individualization of punishment in the direction of its mitigation. |
