Annotation

Ensuring the safety of participants in criminal proceedings is one of the most important guarantees for achieving the goal of modern Russian criminal justice: the prosecution of a guilty person or the release of an innocent person from punishment. Achieving this important result can be based on an assessment of the evidence obtained. The assistance of citizens to establish evidence in the activities of law enforcement agencies causes certain contradictions.The interests of the state in the fight against crime and the legitimate interests of the citizen can be asymmetric. In this regard, the state should create the necessary and sufficient conditions to motivate such assistance. Otherwise, a citizen is not able to potentially assist in the production of a criminal case, since this constitutes a threat to his (close people) interests.
